Applicability of This Privacy Notice

The applicability of this Policy extends to all classifications of users, including but not limited to: individuals who leverage the Platform for the purpose of requesting or administering care services (“Care Seekers”); individuals who utilize the Platform to offer, advertise, or provide caregiving services (“Care Providers”); and individuals who are granted access to TojuCares by virtue of employer-sponsored or other third-party benefit programs (“Participants”). Furthermore, this Policy governs any individual who uses the tools, features, or support channels furnished by TojuCares, whether such interaction occurs via the Platform or through alternative communication modalities, such as telephonic assistance (collectively, the “Services”).

Be advised that this Policy’s jurisdiction is strictly confined to the data-handling practices of TojuCares and its parent entity, KPSE Technologies LLC, as they pertain to the aforementioned Platform and Services. It expressly excludes from its purview any external websites, applications, or services accessible via hyperlinks from the Platform but operated by independent third parties. Such third-party platforms are subject to their own distinct privacy policies, and their data management practices are governed exclusively by their respective terms and conditions.

On occasion, TojuCares may furnish supplemental notices or service-specific privacy disclosures at the point of data collection or upon your registration for particular features. These disclosures are designed to provide enhanced clarity regarding our data-handling protocols for specific Services or circumstances. In the event of a direct conflict between the provisions of this Policy and any supplemental notice, the terms of the supplemental notice shall prevail for that specific interaction or data collection event.

Moreover, this Policy shall not extend to or govern the data practices of any affiliates, partners, or subsidiaries of KPSE Technologies LLC that maintain and operate their own digital platforms or service offerings under separate and distinct privacy policies. Your engagement with any KPSE-affiliated service that is subject to a different privacy policy will be controlled by the terms of that policy, which will be presented to you at the time of use.

For the purposes of interpreting this Policy:

The terms “TojuCares,” “we,” “us,” and “our” shall refer to KPSE Technologies LLC and any entities duly authorized to participate in the delivery of the TojuCares Platform and Services.
The term “You” shall encompass any visitor, user, or participant who accesses the Platform or utilizes the Services in any capacity.

It is hereby stipulated that this Privacy Policy does not apply to any organizations, agencies, or corporate entities that utilize the TojuCares Platform pursuant to a separate, executed contractual agreement. Their engagement with the Platform is exclusively governed by the terms and conditions to which they assented upon registration or as stipulated in their contract with KPSE Technologies LLC. Any capitalized terms not explicitly defined within this Policy shall have the meaning ascribed to them in the TojuCares Terms of Use or, where relevant, the TojuCares Business Services Terms.

 

Information Collected and Sources

The specific data we collect and process is determined by how you interact with the TojuCares Platform and which of our Services you leverage. You may browse certain areas of our Platform without providing any personal information beyond that automatically collected. Individuals who browse the Platform without creating an account are referred to as “Visitors.” To access our core care-matching features and Services, you must register an account, at which point you become a “Member.”

A. Information You Directly and Voluntarily Provide

When you actively provide information to us—whether during account creation, when submitting a care request, building a provider profile, communicating through our secure messaging system, or interacting with our support teams via phone or email—that data is stored and managed by TojuCares in accordance with this Privacy Policy. By furnishing this information, you affirm that you have the legal right and authority to provide it, whether it pertains to you or another individual.

You may provide us with information in the following ways:

1. During Member Registration: When you create a TojuCares account, we collect the essential information you supply on our registration forms. This typically includes your full name, email address, phone number, physical address, and date of birth. We may also offer registration via third-party authenticators (e.g., Google or Apple). If you use a paid Service, our designated payment processor will collect and securely store your payment details, such as credit card numbers and billing information.

2. When Submitting a Care Request (Care Seekers): If you are seeking care, we collect all details pertinent to your request. This may include the specific type of care needed, scheduling preferences, location, proposed budget, details about the care recipient (such as age or relevant health conditions you choose to disclose), specific qualifications for a Care Provider, and any photos or supplementary documents you decide to upload.

3. When Creating a Profile (Care Providers): If you are a Care Provider, we collect the professional and personal details you add to your public-facing profile. This can include the services you offer, your availability, service area, educational background, languages spoken, certifications, personal biography, photographs, background check results, and any other information you choose to feature.

4. When Using Employer-Sponsored or Third-Party Benefits: If you access TojuCares through a corporate or third-party benefits program, we collect information necessary to facilitate those services. This may include details about your backup care requests, information needed to process reimbursements, or data related to inquiries made to our Care Specialists. Use of certain integrated third-party services will be subject to that partner’s privacy policy.

5. Through Direct Communication and Platform Use: We collect and store information you provide when you use our on-platform communication tools to message other Members, interact with our customer support channels, or utilize other interactive features.

B. Information We Receive from External Sources

TojuCares also processes data about you that is obtained from third parties to maintain a safe and reliable platform.

1. From Other Members and Users: We collect information that Members and Visitors may provide about one another, such as written reviews, ratings, and references.

2. From Identity and Safety Verification Partners: As outlined in our Terms of Use, you authorize TojuCares to use third-party services to perform safety and verification checks. These checks help confirm the accuracy of the information you provide (such as your name and address) by cross-referencing it with public records, including but not limited to criminal record databases and sex offender registries.

3. From Background Check Providers: With your explicit consent, we may facilitate a formal background check conducted by a third-party consumer reporting agency. TojuCares may receive a copy of the results of any such report in accordance with the terms presented at the time of your authorization.

4. From Third-Party Login Services: If you choose to register or log in using a third-party service like Google or Apple, you authorize that service to share certain account information with us. The data we receive is controlled by your privacy settings on that platform and may include your name, email address, and profile picture.

5. From Our Service and Payment Partners: When you engage with integrated third-party services via TojuCares, such as payment processors or specialized care agencies, those partners may share transactional or service-related information with us.

6. From Other Data Sources: We may supplement the information we collect with data from other sources, such as business partners and data analytics providers. This helps us ensure data accuracy, prevent fraud, and better understand our users’ needs.

C. Information Collected with Your Explicit Permission

In certain situations, we will request your express consent before collecting specific types of data. For example, our mobile application may ask for permission to access your device’s precise geolocation (GPS) to help you find local care options or to access your device’s contacts to help you invite others to the platform. You can grant or revoke these permissions at any time through your mobile device’s settings menu.

D. Passively and Automatically Collected Data

We automatically gather certain technical information about the computer or mobile device you use to access the TojuCares Platform.

1. Log Data and Device Information: When you use our Services, our servers automatically record data that your browser or device sends. This log data may include your IP address, device type and settings, operating system, browser information, and unique device identifiers.

2. Cookies, Pixels, and Tracking Technologies: Like most online services, we use cookies and similar technologies (such as tracking pixels) to recognize you, remember your preferences, and learn how you interact with our Platform. These technologies also help us measure the effectiveness of our marketing campaigns and customize your experience. You can typically control cookie use at the browser level, but disabling them may limit your ability to use certain features of our Services.

3. Analytics and Advertising Services: We work with third-party analytics partners, like Google Analytics, to understand how our Services are used. 4. Social Media Features: Our Platform may include integrated social media features, such as a “Share” button. These features may collect your IP address and other data, and your interactions with them are governed by the privacy policy of the social media company that provides the feature.

The data we collect is integral to our mission of building a trusted care community. We use your information for three primary purposes: to operate and improve the TojuCares platform, to communicate with you effectively, and to maintain a safe and secure environment for all our Members.

A. For Core Business and Platform Operations

We use your information to power the day-to-day operations of our Services and to enhance your experience continuously. This includes using your data to:

  1. Administer Your Account: Create, manage, and service your TojuCares account and facilitate your access to our Services.
  2. Enable Connections: Display Care Seeker job postings and Care Provider profiles to facilitate matches. Our platform logic uses the information you provide to connect Care Seekers with Providers who appear to meet their specified needs and preferences.
  3. Facilitate Communication: Enable Members to search for, connect with, and communicate with one another through our secure, on-platform messaging tools.
  4. Improve Our Services: Analyze usage patterns and user data to conduct internal research, generate reports, and improve the accuracy, effectiveness, and usability of our platform. This allows us to refine existing features and develop new ones.
  5. Personalize Your Experience: Customize the content and promotional messages you see on the TojuCares platform or on third-party sites to be more relevant to your interests.
  6. Manage Programs and Benefits: If you are a Participant in an employer-sponsored program, we use your information to fulfill requests for services like Backup Care, process reimbursements, and administer any other benefits for which you are eligible.
  7. For Communication, Feedback, and Marketing
    We believe in maintaining an open line of communication with our Members. We may use your contact information to:
  8. Respond to Inquiries: Contact you in response to your questions and provide customer support.
  9. Gather Feedback: Solicit your input and feedback to help us understand your needs and improve our Services.
  10. Provide Updates and Offers: Notify you about new platform features, special events, or other products and services that we believe may be of interest to you. These communications may be sent via email, SMS messages, or other channels.
  11. Conduct Targeted Advertising: Present you with relevant TojuCares advertisements on third-party websites and platforms. This may include finding audiences with similar interests to yours.
  12. For Safety, Security, and Compliance

  18. To Improve Platform Features: We may process the content you provide (such as in job posts or profiles) with AI tools to help you create more effective listings or to provide you with better search results. This data is used to improve our internal tools and for business analytics.
  19. For Content Moderation and Fraud Detection: We use automated systems to help moderate content, detect prohibited or suspicious activity, prevent fraudulent transactions, and protect against security threats. These systems process personal information and account activity to help maintain a safe platform.
    Be assured, we will not use your personally identifiable information to train external, third-party AI models without your explicit consent or as otherwise required by law and disclosed to you.
  20. Information for Employment Applicants
    If you apply for a position at TojuCares, we collect the information you submit in your application, such as your resume, contact details, employment history, and professional qualifications. We may also receive data from recruiters or references you provide. This information is used solely to evaluate your candidacy, communicate with you regarding your application, and comply with legal hiring requirements. We retain applicant information to consider you for future opportunities unless you request its deletion.

    F. Aggregated and De-Identified Data
    We may aggregate and/or de-identify the information we collect so that it can no longer be linked to you or your device. This anonymized data is not subject to this Privacy Policy, and we may use and disclose it for any purpose without restriction, such as for industry analysis or service improvement.

To operate the TojuCares platform effectively and facilitate meaningful connections, we share your information with third parties under the specific circumstances outlined below. Your use of our Services constitutes your agreement to these data-sharing practices. You can manage certain disclosure preferences within your account settings.
A. Information Shared with Other Members and the Public
To maximize your ability to find care or a caregiving opportunity, certain information you provide is part of your public or semi-public profile and is visible to others.

  1. Publicly Visible Information: To allow Visitors and Members to browse opportunities, we display key profile information, which may include your first name, last name, city, state, profile picture, and the description of your services or care needs. We do not display your direct contact information publicly.
  2. Information for Members: When logged into the Platform, Members may see additional details, such as company reviews you have posted, your approximate location plotted on a map (which you can choose to make confidential), and your hourly rate. If you are a Care Seeker viewing a Provider’s profile, the Provider may be notified that you have viewed their profile, a feature you can opt out of.
  3. Group Forums: Any information you voluntarily post in a public forum on our Platform, such as a community group, may be viewed by any Visitor or Member who accesses that forum.
  4. With Our Third-Party Vendors and Service Providers
    We engage a network of third-party companies (“Vendors”) who act as our processors to perform essential services on our behalf. We share information with these Vendors only to the extent necessary for them to perform their designated functions, and we contractually require them to safeguard your data. These functions include:

  6. Identity and Safety Verification: To conduct background checks and identity verification.
  7. Communications and Marketing: To manage email, SMS notifications, and marketing campaigns.

  11. To Enhance Your Visibility on Third-Party Platforms
    To increase your visibility and help you connect with a wider audience, we may share select, non-sensitive information from your profile or job posting with external partners.
  12. Search Engines and Job Boards: Selected information, such as your photo, first name, city, and description, may be indexed by and displayed in the search results of third-party search engines (e.g., Google) and on partner job boards. You can opt out of this feature in your account settings.
  13. Social Media Integrations: If you connect your TojuCares account to a third-party service like Facebook, you may have the option to post your activity from our Platform back to your social media feed.
  14. For Legal, Safety, and Compliance Reasons
    We may disclose your information when we have a good-faith belief that it is necessary to:

  1. With Our Corporate Affiliates and Employer Sponsors
  2. Affiliated Companies: We may share your information with our parent company, subsidiaries, or other companies under common control for the purposes of operating the Platform, providing integrated Services, and for other shared commercial purposes.
  3. Employer-Sponsored Programs: If you access TojuCares through a corporate benefits program, we may share utilization data with your employer or their designated administrator. This may include aggregated, non-identifiable statistics or specific information such as the types of care you have sought and the hours of backup care used.

 

 

  1. To Facilitate Background Checks

    As a precondition for activation on the TojuCares platform, all Care Providers must authorize and complete a background check conducted by our designated consumer reporting agency partner, Checkr. TojuCares facilitates this process by connecting you with our vendor; we do not conduct the background checks ourselves, but we will receive confirmation of their completion.
    Your authorization grants our vendor permission to conduct the check and to disclose the resulting report to TojuCares and to any Member who formally requests it in connection with a potential hiring opportunity.

  2. In the Event of a Business Transaction
    If TojuCares is involved in a merger, acquisition, asset sale, or other corporate transaction, your information may be transferred as part of that deal. You acknowledge that this Policy permits such transfers, and any acquirer may continue to process your information as set forth herein.

  3. With Your Explicit Consent
    In any circumstance not covered above, we will only share your information with a third party with your express consent.

Managing Your Communication Preferences
When you register as a Member on TojuCares, you agree to receive essential communications from us related to the operation of your account and the Services. You have significant control over the types of promotional messages you receive.

  1. Promotional and Marketing Communications: This includes special offers, newsletters, user surveys, and notifications about new Members in your area. You can opt out of these marketing emails at any time by adjusting the settings in your TojuCares account or by clicking the “unsubscribe” link located at the bottom of any marketing email.
  2. Transactional and Administrative Communications: These are essential, non-promotional messages regarding the platform and your account. Even if you opt out of marketing messages, we will continue to send you critical administrative notices. Examples include updates to our Privacy Policy or Terms of Use, security notifications, and direct responses to your job postings or applications.
  3. SMS and Phone Communications: You can manage your preferences for receiving marketing SMS messages or phone calls from us directly within your account settings.

If we cannot verify your identity, we may be unable to fulfill your request.

    You may be able to designate an authorized agent to act on your behalf. We will require written permission signed by you or a power of attorney before we can process a request from an agent.

    C. Notice of Right to Opt-Out of “Sales” and “Targeted Advertising”
    Certain state laws define the use of third-party advertising and analytics cookies as a “sale” or “share” of personal information or as processing for “targeted advertising.” We do not sell your data for monetary value, but we do engage with these third-party partners as described in this policy.

    Updating Your Information and Closing Your TojuCares Account

  3. Account Closure: If you no longer wish to use our Services, you may permanently close your account through your account settings. Upon closure: Your profile and other personally identifiable information will be removed from public view on the TojuCares platform. We have no obligation to retain your data and may delete it without liability.
    However, we may retain certain information for legitimate business purposes, such as preventing fraud, analyzing aggregated and de-identified data, enforcing our legal agreements, or complying with our legal obligations. Please note that information you have shared with other Members (such as messages) may remain visible to them after your account is closed, just as a sent email remains in the recipient’s inbox. TojuCares has no control over third-party search engines caching your information.

    Our Policy Regarding Children
    The TojuCares platform and its Services are intended exclusively for individuals who are 18 years of age or older. We do not knowingly collect any personal information from children under the age of 13. If we become aware that we have inadvertently collected such information, we will take immediate and reasonable steps to delete it from our systems in compliance with applicable law.

Once you click a link and leave our site, our privacy policy is no longer in effect. The data practices of that third-party website are governed by its privacy policy, which we encourage you to read carefully. We do not assume responsibility for the content or privacy practices of any third-party sites.

Changes and Updates to This Policy
As our services evolve, we may need to update this Privacy Policy. TojuCares reserves the right to amend this policy at any time.

To help you build a comprehensive profile, we collect Professional or Employment-Related Information (such as your work history, qualifications, and references) and **Protected Classification Characteristics (such as age and gender, which you can optionally provide). This information populates your public profile to help us match you with suitable opportunities and may be viewed by other Members and shared with our background check vendors for verification.

Our platform automatically collects Commercial Information, such as your transaction history, and Internet or Other Electronic Network Activity, including your browsing history and interactions with our site. We use this to maintain your account, understand your preferences, improve our platform’s functionality, and protect against fraudulent activity. This data may be shared with our analytics partners, advertising networks, and security vendors.

To enhance our services, we may use Geolocation Data (your approximate location or, with your permission, precise GPS data) to connect you with local opportunities. We also collect Audio, Visual, or Similar Information, such as your profile photos or voice recordings from support calls, which are used to populate your profile and for quality assurance. This information may be shared with other Members or our service providers.

Finally, based on the data you provide, we may create Inferences about your likely preferences and interests. We use these inferences to personalize your experience on TojuCares, suggest relevant matches, and customize the content you see. The data used to inform these inferences may be shared with our advertising partners.

B. Use of Sensitive Personal Information
We may collect certain Sensitive Personal Information, including your account login credentials, precise geolocation (with your consent), and the contents of messages you exchange with other Members on our platform. We use this information only for essential business purposes permitted by the CCPA, such as providing the services you requested, securing your account, and protecting the safety of our community. As our use is limited to these necessary functions, we do not offer a “Right to Limit” this use under the CCPA.

 

Your California Privacy Rights

In addition to the rights outlined in the “Your Legal Rights Regarding Your Personal Data” section above, California law provides residents with the following specific rights and notices.
 The Right to Opt-Out of “Sale” and “Sharing”
California law defines the terms “sale” and “sharing” broadly, and requires us to provide you with a way to opt out of these activities.
What is a “Sale” or “Share”? Under the CCPA, a “sale” can include any disclosure of personal information in exchange for a benefit, even if no money changes hands. “Sharing” specifically refers to disclosing personal information to third parties for cross-context behavioral or targeted advertising. As described in this policy, we use certain third-party analytics and advertising tools that may fall under these definitions.

How to Opt-Out: You can exercise your right to opt out of the use of your personal information for these purposes in two ways:

  1. Footer Link: Click the “Your Privacy Choices” or “Do Not Sell or Share My Information” link in the footer of our website.

Our Policy on Browser Tracking Signals (GPC vs. Do Not Track)

It is important to distinguish between two types of browser signals:
Global Privacy Control (GPC): As stated above, we recognize and honor the GPC signal as a valid request to opt out of sales and sharing.
Do Not Track (DNT): DNT is an older browser setting distinct from the GPC. Our platform does not currently respond to or honor DNT signals. We engage in tracking to optimize our Services, customize your experience, detect and prevent fraud, and ensure the safety of our community. However, our use of your information will always be governed by the terms of this Privacy Policy.
